Impending Regulations Affecting AI in HR

New York City passed a law aimed at reducing bias in automated employment decisions, which comes into effect on January 1st, 2023. The NYC Automated Employment Decision Tool law (“AEDT”) places compliance obligations on employers in New York City that use AI tools. Accordingly, companies should pay close attention to any AI tools or algorithms being used in the hiring process, to ensure that they are compliant with these emerging requirements.

Similar laws are likely to be enacted in other jurisdictions. The European Union (EU) has proposed to regulate the use of AI in HR, which could impose similar obligations on service providers and employers.
